Welcome to NalDey Kontent! By accessing or using our platform and social content editing services, you agree to be bound by the following Terms of Service. Please read them carefully.

1. Acceptance of Terms

By using NalDey Kontent, you agree to these Terms of Service, our Privacy Policy, and any additional terms that may apply. If you do not agree, please do not use our services.

2. Description of Service

NalDey Kontent provides social media content creation and editing services, including but not limited to: short-form video editing (Reels, TikTok, Shorts), carousel design, thumbnail creation, and caption/text overlay work. Services are delivered according to your active subscription plan.

3. User Accounts

To access our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old or have parental consent to use our platform.

4. Content Ownership

You retain full ownership of all content you upload and all edited content we deliver to you. By uploading content, you grant us a limited, non-exclusive license to access and edit your content solely for the purpose of delivering the Service.

Once delivered, edited content is yours to use, publish, or distribute as you see fit. We claim no rights to your content.

5. Acceptable Use

You agree not to upload or request content that:

• Is unlawful, harmful, threatening, defamatory, or offensive.
• Infringes on intellectual property rights of others.
• Contains malware or harmful code.
• Violates any applicable laws or regulations.

We reserve the right to refuse any project that violates these guidelines.

6. Intellectual Property

All branding, software, and website content associated with NalDey Kontent (excluding user content) are owned by or licensed to NalDey Kontent and are protected by copyright and other laws.

7. Payments & Subscriptions

All payments are processed securely by Stripe, a PCI-DSS Level 1 certified payment processor. Prices are displayed in euros (EUR) unless otherwise stated.

By subscribing, you authorize us (and Stripe on our behalf) to charge your selected payment method for the applicable subscription amount, including any taxes. Subscriptions automatically renew at the end of each billing period unless canceled.

We do not store complete credit card numbers or CVC codes on our servers. All payment information is transmitted directly to Stripe via industry-standard encryption.

8. Refunds & Cancellations

Refund Policy: If you are unsatisfied with our service within the first 14 days of your initial subscription and no content has been delivered, you may request a full refund. Once content has been delivered, refunds are not available for that billing period.

Cancellation: You may cancel your subscription at any time via your account dashboard or by emailing support@ndey-kontent.pro. Your subscription will remain active until the end of the current billing period.

To request a refund, email support@ndey-kontent.pro from the email address associated with your account. Approved refunds are credited to the original payment method within 5-10 business days.

9. Delivery & Revisions

Standard delivery time is 24-48 hours for most projects. Complex projects may take 3-5 business days. Delivery times are estimates and not guaranteed.

Revision requests are included according to your subscription plan. We will make reasonable efforts to accommodate your feedback and deliver content that meets your expectations.

10. Chargebacks & Disputes

If you initiate a chargeback or payment dispute, we may suspend your account until the matter is resolved. We reserve the right to contest any illegitimate chargebacks and to recover any associated fees.

11. Termination

We reserve the right to suspend or terminate your access to the services at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

12. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee specific results, engagement, or performance of the content we create.

13. Limitation of Liability

To the fullest extent permitted by Austrian law, NalDey Kontent shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the services. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless NalDey Kontent, Julius Weber, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, the content you upload, or your misuse of the services.

15. Changes to Terms & Pricing

We may update these Terms or our pricing at any time. Material changes will be communicated via email or through the Service. Price changes take effect at the start of your next billing cycle. Continued use after changes constitutes acceptance.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Austria. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Vienna, Austria.
